Section 01
Privacy Policy
1.1 Data Controller
freshsignalpoint, registered at Hauptplatz 1, 2700 Wiener Neustadt, Austria, is the data controller responsible for the processing of personal data collected through this website and related services. For all inquiries regarding data protection, contact us at [email protected].
1.2 Data We Collect
We collect personal data voluntarily provided by users, including: full name, email address, phone number, postal address, project briefs, and payment information processed through third-party payment processors (Stripe). We do not collect special categories of personal data (health, biometric, political opinions, etc.).
1.3 Legal Basis for Processing
Processing is conducted under Article 6(1)(b) of the EU General Data Protection Regulation (GDPR): performance of a contract to which the data subject is party, and Article 6(1)(f): legitimate interests pursued by the controller, including direct marketing and service improvement.
1.4 Data Retention
Personal data is retained for the duration of the client relationship and for a maximum period of 5 years following the last service engagement, unless a longer retention period is required by Austrian or EU law. Project-related data may be anonymized and retained for portfolio purposes.
1.5 Data Subject Rights
Under the GDPR, you have the right to: access your personal data (Article 15), rectification of inaccurate data (Article 16), erasure ("right to be forgotten") (Article 17), restriction of processing (Article 18), data portability (Article 20), and object to processing (Article 21). 1.6 International Transfers
Data may be transferred to third-party processors located outside the European Economic Area (EEA), including the United States. Such transfers are protected by Standard Contractual Clauses (SCCs) as approved by the European Commission in compliance with Chapter V of the GDPR.
1.7 Supervisory Authority
You have the right to lodge a complaint with the Austrian Data Protection Authority (Datenschutzbehörde), Barichgasse 40-42, 1030 Vienna, if you believe your data protection rights have been infringed.
Section 03
Refund Policy
3.1 Project-Based Services
All services provided by freshsignalpoint are project-based. Upon acceptance of a project proposal and receipt of payment, work commences immediately. Refund eligibility is determined based on the project milestone at which cancellation is requested.
3.2 Cancellation Before Work Begins
If cancellation is requested within 48 hours of payment and before any substantive work has commenced, a full refund minus a 10% administrative fee will be issued within 14 business days.
3.3 Cancellation During Active Project
If cancellation occurs after work has begun, the client is entitled to a partial refund proportional to undelivered milestones. Delivered work products remain the intellectual property of freshsignalpoint until full payment is received.
3.4 Subscription & Retainer Services
Monthly retainer or subscription services may be cancelled with 30 days' written notice. No refund is issued for the current billing period in which cancellation is received.
3.5 Dispute Resolution
Refund disputes are handled in accordance with Austrian consumer protection law (Konsumentenschutzgesetz, KSchG). Clients may contact the Austrian consumer arbitration board (Verbraucherschlichtungsstelle) for mediation.
Section 04
Terms of Service
4.1 Scope of Agreement
These Terms of Service ("Terms") govern the use of all services provided by freshsignalpoint, located at Hauptplatz 1, 2700 Wiener Neustadt, Austria. By engaging our services, the client ("Client") agrees to be bound by these Terms in their entirety.
4.2 Service Delivery
freshsignalpoint will deliver services as outlined in the accepted project proposal. Delivery timelines are estimates and may be adjusted in good faith to accommodate scope changes. The Client will be notified of any material timeline adjustments within 5 business days.
4.3 Payment Terms
Payment is due as specified in the project proposal. Invoices are payable within 14 days of issuance. Late payments accrue interest at the statutory rate under Austrian law (currently 4% per annum). Services may be suspended for invoices outstanding beyond 30 days.
4.4 Intellectual Property
Upon receipt of full payment, all deliverables become the exclusive intellectual property of the Client. Source code, design files, and brand assets are transferred without restriction. freshsignalpoint retains the right to display completed work in its portfolio unless otherwise agreed in writing.
4.5 Confidentiality
Both parties agree to maintain strict confidentiality regarding proprietary information exchanged during the engagement. This obligation survives termination of the agreement for a period of 3 years.
4.6 Limitation of Liability
freshsignalpoint's total aggregate liability shall not exceed the total fees paid by the Client under the applicable project proposal. We shall not be liable for indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities.
4.7 Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of Austria. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Wiener Neustadt, Austria.
